1. Scope

The following General Terms and Conditions apply to all orders placed via our online order form on our website, www.crb-gmbh.com.

Customer’s deviating, conflicting or supplementary terms and conditions shall not apply, even if CRB Analyse Service GmbH is aware of such terms and conditions, unless such terms and conditions have been explicitly agreed to in writing.

 

2. Limitation of service performance

We only accept samples taken in the Federal Republic of Germany, Austria and Switzerland.

 

3. Contractual partners

A contract is concluded with CRB Analyse Service GmbH, Bahnhofstrasse 14, 37181 Hardegsen, Germany, represented through its General Manager, Mr. Ralf Klaus Blecher, Göttingen commercial register HRB 141525.

 

4. Placement of order/conclusion of contract

You can use the online order form on our website at www.crb-gmbh.com to commission us with the analysis of the samples listed there.

By providing our order form, we submit a binding offer to conclude a contract for the analysis of the selectable sample types.

Use our order form to select the type of sample you want us to analyze and to specify its designation. You can click “Add sample” to add further samples to your order without any obligation.

Next, specify the required data. Mandatory entries are marked by an asterisk (*). Then select the payment mode.

By clicking the “Place order and pay” button, you commission us to analyze the samples listed and thus enter into a contract with us. Before you click this button, you can abort the order process by simply closing the browser. Also, you are free to remove individual samples from the form by clicking the “Delete” (trash can) icon.

After you have submitted your order to us, you will receive a confirmation e-mail. Remember to send your samples to us so we can analyze them.

 

5. Performance of contract

We duly carry out your order without bias and without instructions and with due diligence. If necessary and at our discretion, we may subcontract the analysis without requiring your explicit consent.

 

6. Contract text

We store the contract text on our internal systems. You are free to review our General Terms and Conditions via our website at www.crb-gmbh.com. We will send your order data and our General Terms and Conditions to you by e-mail.

 

7. Right of revocation

Consumers have the right to cancel or revoke their order within two weeks following placement of the order. A consumer is any natural person who concludes a legal transaction for purposes which may predominantly be attributed neither to commercial nor to self-employed professional activity (Section 13, German Civil Code of Law).

of your decision to revoke this contract by sending us an express statement (e.g. a letter by mail, fax, or e-mail) to that effect. You may – but are not obliged to – use the attached sample revocation form. To comply with the revocation period, it is sufficient that you send your notification of exercising your right of revocation before the expiry of the revocation period.

Consequences of revocation

If you revoke this contract, we shall reimburse you immediately – and no later than fourteen days from the date on which we received notice of your revocation of this contract – for all payments we have received from you, including delivery charges (excluding additional charges arising from your choice of delivery method other than the lowest-cost standard delivery offered by us). For this refund, we will use the same payment mode that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged for this refund.

If you have requested that the services be commenced prior to the revocation deadline, you are obliged to pay us a reasonable amount equal to the proportion of services already provided – on a pro-rata basis in relation to the full scope of services specified in the contract – up to the time you notify us of the exercise of the right of revocation of the contract.

According to § 356 paragraph 4 BGB (German Civil Code), the right of revocation also expires if we have completely provided the service and have begun providing the service only after you have given your express consent and have acknowledged that you lose your right of revocation once we have completely fulfilled the contract.

8. Prices and shipment costs

(1) The prices stated in our order form include the statutory value added tax and all other price-related components such as express surcharges.

(2) Please send the sample to be analyzed to: CRB Analyse Service GmbH, Bahnhofstrasse 14, D-37181 Hardegsen, Germany. Samples to be checked for asbestos should be supplied in very small quantities of representative material:

  • One sample of 1 x 1 cm in size for material specimens
  • The content of a thimble in the case of dust samples

is more than sufficient.

The costs for sending the material samples shall be borne by you.

For dust samples, we can optionally send you a free sample receptacle with an adhesive surface which you can press into the suspicious dust to collect it.

(3) We will send you the result of our analysis by e-mail, free of postage or shipping fees.

 

9. Processing time

The “standard” service processing time for sample analyses is approx. 3-4 days after receipt of the sample. At an express surcharge, processing can be performed within a shorter time period. When ordering, you can select from various "express services" options. Please be aware of the applicable processing times.

Express 1: If we receive your sample by 9:00 am, you will receive the analysis report within 24 hours of sample receipt.

Express 2: If we receive your sample by 9:00 am, we will start processing it immediately. You will receive the result within 4 hours. If you send more than 5 samples, the processing time will be extended by approx. 30 minutes per additional sample.

Express 3: Provided that you notify us in advance, we will process your sample even if we receive it on weekends, public holidays, or weekdays from 5:00 pm through 8:00 am. You will receive the result within 4 hours. If you send more than 5 samples, the processing time will be extended by approx. 30 minutes per additional sample.

If you select “prepayment” as your payment method, the associated processing time begins once we have received your sample, the amount due has been credited to our business account, and the transfer has been assigned to your order. The time between receipt of payment and allocation is approx. 1 to 2 days.

 

10. Payment

We accept the following payment methods: credit card, paydirekt, PayPal, and prepayment.

(1) If you select “credit card” as your payment method, enter your credit card data and then click the “Place order and pay” button. Your credit card data will be forwarded to us together with your order. Once you have identified yourself as the legitimate cardholder, we will prompt your credit card company to initiate the payment transaction immediately following receipt of your order. The payment transaction will then be processed by your credit card company and charged to your card.

(2) You can use the “paydirekt” payment method only if you register for or are a registered user of paydirekt. To register, you need to have a bank account plus access to your bank’s associated online banking services. If you select “paydirekt” as your payment method, you will be redirected to the www.paydirekt.de website of paydirekt GmbH, Hamburger Allee 26-28, 60486 Frankfurt am Main, Germany, after you click the “Place order and pay” button and then the paydirekt logo. Following mandatory authentication and authorization of your payment to us, the paydirekt payment is immediately initiated. The paydirekt payment is processed via an interim account, ensuring that we do not receive your account number. By releasing your payment via paydirekt, you implicitly initiate the transfer of the amount due for the paydirekt payment to the interim account. (3) You can also use the “PayPal” payment method. After you have selected and specified your samples via our order form, click the “PayPal” button on the shopping cart page to access your PayPal account. Log in by entering your user data, select the address and click the “Next” button to confirm.

You will then be returned to our order overview page. Check your order and make any necessary changes or adjustments. Then click the “Place order and pay” button to complete your order. Your PayPal account will be charged accordingly.

Payments via “PayPal” are subject to the “PayPal terms and conditions of use” of PayPal (Europe) S.à r.l. & Cie, S.C.A. Check www.paypal.com for the applicable terms and conditions set forth by PayPal (Europe) S.à r.l. & Cie, S.C.A. that you need agree to when becoming a PayPal users.

(4) If you select the “prepayment” payment method, we will send you our bank details plus the reference to your order via our order confirmation e-mail. Please be sure to state the reference in the bank transfer so that we can assign your payment to your order.

This contract is concluded in German.

 

12. Warranty

The statutory liability for defects applies.

 

13. Out-of-court online dispute resolution

14. Applicable law

German law applies. Insofar as mandatory consumer law provisions are concerned, the law of the end consumer's place of residence shall apply.

We shall not disclose, pass on or make use of such data and information without due authorization, unless such data and information is in any case generally accessible or expressly intended for publication. In case of doubt, such data and information shall be treated confidentially. We shall disclose, pass on or make use of said data and information ourselves only to the extent that we are obliged to do so by law or if you have expressly relieved us of our confidentiality obligations. We undertake to use analysis results obtained within the scope of your contract for scientific purposes or publish such results or subject such results to an independent scientific evaluation only in consultation with you and provided that you grant your consent.

(2) The confidentiality obligation shall extend beyond the end of the contract for an unlimited period of time.

 

16. Use of analysis report

The use of the analysis report, in particular any reproduction and distribution of the report, is only permitted if CRB Analyse Service GmbH is explicitly mentioned by name.

 

17. Limitations of liability

We are fully liable for damages caused by us or our legal representatives or agents, regardless of the legal basis, in the event of intent or gross negligence.

In cases of slight negligence, we shall only be liable in the event of breach of a material contractual obligation (the performance of which is essential to the contract and on which you are entitled to rely), but limited in amount to the foreseeable, direct and typically contract-related damages at the time of conclusion of the contract, provided that no major damage is incurred and recorded.

The statutory liability for injury to life, body or health, in case of fraudulent intent, in case of violation of guarantees and according to the Product Liability Act shall remain unaffected by these limitations of liability.

Your statutory warranty claims (see Section 12) also remain unaffected by these limitations of liability.

1. Access data and hosting

You may visit our website without revealing any personal information. If you have requested that the services be commenced during the withdrawal period, you shall pay us a reasonable amount equal to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal in respect of this contract in relation to the total services provided for in the contract.

According to section 356 (4) BGB, the right of withdrawal expires also in those cases in which we have completely provided the service and began with the performance of the service only after you had given your express consent thereto and concurrently acknowledged that you would lose the right to withdraw from the contract once we have fully performed the contract.
